On November 02, 2009, we have been notified that the proportion of voting
rights via shares of Barclays Global Investors NA, San Francisco, USA, has
exceeded the threshold of 3% of the voting rights in Merck KGaA, Darmstadt,
Germany, on October 27, 2009 and at that time amounted to 3.13% (2,022,489
voting rights).
2.50% of these voting rights (1,616,120 voting rights) are attributable to
Barclays Global Investors NA pursuant to § 22 para 1 sentence 1 no. 6 WpHG.
0.63% of the voting rights (406,369 voting rights) are attributable to
