us according to § 21, para 1 WpHG that via shares its voting rights of
Merck KGaA, Darmstadt, Deutschland, have exceeded the threshold of 3% of
the voting rights on March 27, 2008 and on that day amount to 3.73% (this
corresponds to 2408684 voting rights). These voting rights are attributed
to Morgan Stanley according to § 22 para 1 sentence 1 no.1 WpHG.
